Darna Rewards Terms and Conditions

Effective from 13 November 2025

A. General

  1. Darna Rewards by Aldar (the “Programme” or “Darna”) is a loyalty programme operated by Aldar Properties PJSC, its subsidiaries and group companies (hereinafter referred to as “Aldar Group”, “Aldar”, “we” or “us”) in accordance with these Terms.
  2. If you join the Programme and become a Darna member (“Member”) these Terms will become a contract between you and Aldar.
  3. As a Member you will earn loyalty points (“Points”) when making qualifying purchases on products and services at participating Aldar Group companies and its partner outlets (“Participating Outlets”), by presenting the Darna mobile application (“Darna App”), using a linked registered Visa or MasterCard debit or credit card (“Linked Card”) or registered email address (which was used for enrolment on the Darna App) at the time of purchase.
  4. Aldar may also partner with one or more providers of goods or services and allow them to participate in the Programme from time to time (“Programme Partners”). As a Member, you would be able to either earn or redeem Points at Programme Partners and Participating Outlets.
  5. These Terms relate to the membership, earning and redeeming of Points, usage of tier benefits, redemptions of Darna rewards under the Programme (“Rewards”) and redemptions of offers available to Darna Members (“Offers”).
  6. Aldar reserves the right to modify, cancel or withdraw the Terms at any point of time at Aldar's own discretion. This includes the right to withdraw or cancel any or all of the Darna memberships issued, refuse to award Points, withdraw Points, refuse the right to redeem Points collected for any breach of these conditions or failure to pay for the purchases without prior notice.

B. Important Things to Know About Participating in Darna

  1. In the course of operating Darna and providing Member benefits and features of the Programme, we collect and handle your personal information. This assists us in the membership registration process, allocating of Member benefits and Points, promoting services and products offered by us, our related companies and partners, and providing a customised experience when you interact with the Darna Programme.   2. You consent to receiving marketing and promotional communications from us and partners by email, text message or other digital service, phone or post, subject to our Privacy Policy and obligations under applicable laws. You can read more about our marketing practices in our Privacy Policy, including how to manage marketing communications preferences. You can unsubscribe from our contact list at any time using the “unsubscribe” facility in our electronic messages, by managing your contact preferences through your Darna account when logged in to the Darna App or by contacting us.
  3. Subject to your rights under any applicable laws and to the extent allowed by law, we and our related companies, contractors, partners and their officers, employees, agents, exclude liability to you for any indirect or consequential loss (including economic loss, loss of profits and loss of opportunity), damage, claim or expense you may suffer in connection with these Terms or the Darna Programme generally.
  4. We may need to change these Terms from time to time. We will act reasonably in making any changes and publish any changes to the Terms on the Darna App and Darna website www.darnarewards.com.
  5. It is important you understand that Member benefits, features, Rewards or Offers of Darna will change over time. This includes but is not limited to changes to:
    • the ways you can earn and redeem Points – i.e. the Participating Outlets or Programme Partners you can earn and redeem with;
    • Points earn rates for eligible transactions – i.e. the number of Points you earn on an eligible transaction;
    • tier status eligibility and associated tier benefits;
    • Points redemption rates – i.e. how many Points it will take to redeem a Reward; and
    • Programme Partners and Participating Outlets, and the earn and redemption rates set by such Programme Partners and Participating Outlets.
  6. We cannot guarantee that Participating Outlets and Programme Partners will continue to be part of Darna, or that any Member benefits, features, Rewards or Offers of Darna will continue to be available. These may change at the discretion of Aldar from time to time.
  7. Aldar reserves the right to change or discontinue the Programme, or to modify, cancel or withdraw any of the Terms at any point of time at its own discretion. It reserves the right to cancel any and all Programme memberships for a duration of time as deemed suitable by Aldar. Aldar will use reasonable efforts to reflect any changes, updates or modifications to the Programme in the Darna App. It is the responsibility of the Member to carefully read and agree to these Terms.
  8. Aldar reserves the right to withdraw or cancel any or all Darna memberships issued for any breach of these Terms. In doing so, Aldar may, without limitation, refuse to award Points, revoke Points and discontinue the redemption of Points at its sole discretion.
  9. Your participation in the Programme, whether it be through the accrual of Points, redemption of Points, redemption of Offers or by any other means of engagement, provides acceptance of these Terms and understanding that they are subject to change from time to time.
  10. Your membership of the Programme will be cancelled with immediate effect if you are involved in any act of fraud or activities deemed detrimental to the Aldar Group. Cancellation of your Darna membership will result in all Points accrued being forfeited.
  11. Aldar has the right to change or revoke any benefits and Offers extended to you as part of the Programme. Aldar will not be responsible for any liability arising from such circumstances.
  12. Aldar will not be liable for any unlawful use or misuse of your Darna Membership, and it is your responsibility to ensure that your Darna Membership is secure and all details are up to date at all times.
  13. As a Member you are responsible for any loss, damage, theft or misuse of your Darna membership. Please report any loss, damage, theft or misuse immediately to the Darna Member Services Centre so the appropriate actions to suspend your Darna membership can be taken.
  14. Any benefits, services or Offers provided to a Member as a result of his/her participation in the Programme, whether these are provided by Aldar or by any Participating Outlets and/or Programme Partner, the Member will be responsible for any and all costs as a result of using a benefit, service or Offer, including but not limited to taxes, surcharges, fees, charges, claims or liabilities. The use of benefits, services and Offers will be subject to the terms and conditions of the provider of said benefits, services or Offers (as applicable). Aldar shall not be liable for any loss or damage, whether direct or indirect, resulting from withdrawal or change of either the Programme or any benefits, services or Offers which are made available to Members.
  15. You are responsible for any and all costs involved in downloading the Darna App on your mobile device. Once downloaded and upon successful sign in, you will have access to your membership details including Points balance, Rewards and benefits.
  16. The sale, transfer or barter of any Points, services, tier levels, Offers or other benefits is strictly prohibited.
  17. These Terms shall be governed by the laws of the United Arab Emirates and any dispute may be referred to the courts of Abu Dhabi, United Arab Emirates.

C. Enrolment and Membership

  1. You will be issued a Darna membership at the time of enrolment against the email address and mobile number which you provide during the registration process. Your registered mobile number will be used as your unique identifier in the Programme.
  2. All Darna memberships remain the property of the Aldar Group and any and all decisions relating to the awarding of memberships shall be at the discretion of Aldar.
  3. Membership to the Programme is free of charge.
  4. To qualify for membership the individual registering must be eighteen (18) years of age or older. Acceptance of these Terms during enrolment provides confirmation that the minimum age requirement has been met.
  5. A Member is permitted to hold only one valid Darna membership in his/her name at any given time. Membership is non-transferable so in the event more than one membership is being held by an individual, Aldar reserves the right to cancel one or all memberships held by the individual and any Points accrued at that time will be lost.
  6. To assist with membership activity and engagement statistical analysis, Aldar will classify Members into ‘active’ and ‘inactive’ statuses. A Member who has not transacted within a 12-month period will be deemed by the Programme as 'inactive'. Active status will be reinstated upon making their next transaction. In the event a Member remains ‘inactive’ for 24-months or a period of time as deemed suitable by Aldar, the Member may have their membership cancelled by Aldar at its discretion. Reasonable efforts will be made to advise the Member of cancellation in advance of doing so.
  7. Your participation in Darna will continue unless you choose to close your Darna membership account. To close your account, you will need to contact the Darna Member Service Centre on customerservice@darnarewards.com. Proof of identity may be required. You will need to manually remove all Linked Cards (see below) from your account.
  8. You can de-link your cancelled/suspended Linked Card(s) by clicking on ‘remove card’ in the ‘Link Card’ section on the mobile app. If you cancel your Darna account or de-link your Linked Card (see below), you will not be allocated any pending Points not awarded at the time of cancellation or de-linkage of the Linked Card. Closing your Darna account will not result in you cancelling your Darna membership.

Use of the App Services and Prohibited Conduct

In accessing or using the Darna App or website, you acknowledge and agree that you:

  1. are solely responsible for maintaining the confidentiality of your login details (including any username, password or other identifying information);
  2. are solely responsible for all the activities that occur using your login details, whether or not engaged in by you; and
  3. will immediately notify us of any unauthorized use of your login details that has occurred in connection with the Darna App or website.
  4. authorise us to use your login details for commercial and advertising purposes, including but not limited to enrolling you in our applications and loyalty schemes.
  • post or transmit any information, content or other material, or otherwise to engage in any activity, in breach of any applicable laws or regulations (including but not limited to any Privacy Laws), or in infringement of a third party’s Intellectual Property Rights or other legal rights;
  • post or transmit any material which is or is likely to be defamatory, harassing, threatening, menacing or offensive, or which restricts or inhibits any other person from using the Darna App or website;
  • send, publish or distribute spam or other unsolicited commercial electronic communications;
  • reverse engineer, modify, tamper with, hinder or compromise our Darna App or website;
  • knowingly transmit any viruses, worms, trojans, other malicious or unauthorized code or disabling features; or
  • attempt any of the acts or facilitate or encourage or assist another person to do any of the acts, referred to in this paragraph (hereinafter referred to as “Prohibited Conduct”).
  • attempt to collect, store, or transmit the Personal Data of any other end user without lawful basis or written authorisation.

Engaging in any Prohibited Conduct may also constitute a violation of UAE Cybercrime Law or data protection legislation, and may be reported to the appropriate legal authorities.

We may, in our sole and absolute discretion, if we suspect that you have engaged in any Prohibited Conduct or otherwise breached these Terms, and without prior notice, terminate your access to and prevent you from using the Darna App and website.

D. Tiers and Tier Benefits

  1. Darna consists of three published tiers, namely Silver, Gold and Platinum. Upon successful registration to the Programme, a Member will be enrolled into the Silver tier.
  2. To achieve and retain higher membership tiers, the following total Tier Credits must be earned through qualifying transactions within the Aldar Group, Participating Outlets and/or Programme Partners (as applicable) over a 12-month period from date of registration or from your last tier upgrade:
    • Silver – 0 – 14,999 Tier Credits
    • Gold – 15,000 – 34,999 Tier Credits
    • Platinum – 35,000+ Tier Credits
  3. Any purchase made before successful completion of Darna registration is not eligible for back-dated points.
  4. Each tier is eligible for tier benefits which are published in the Darna App. All tier benefits are subject to change at any time without prior notification. Where changes are made, Aldar will endeavour to advise you of any changes in advance. To review the latest tier benefits, review the Darna mobile app.
  5. Tier benefits will be a mixture of soft tier benefits and tier-based rewards, also referred to as ‘Offers’. Soft tier benefits will require the member to show proof of valid membership to avail the chosen benefit.
  6. Tier Benefits and tier-based rewards are subject to the Terms as from time to time. For the most up to date terms, please review the details as displayed on the Darna mobile app. Terms of use and any other applicable special conditions are subject to change at any time and at the sole discretion of Aldar.

E. Earning Points

  1. Members may earn Points across participating Aldar Group assets on the AED spend value (not including VAT) within the Aldar asset portfolio that are listed in the app, including:
    • Hotels – F&B, Spa
    • Schools – Aldar Academies
    • Retail Malls and Communities
    • Home Maintenance (Khidmah) – in-home services
    • Golf courses
    • Partners attractions and venues
    • Parks and Beaches

    The Aldar asset portfolio as listed above is subject to change at any time without prior notification. Where changes are made, these will be updated accordingly within the Darna App.

    Points will be credited to the Member’s account in the following ways:

    • Education – post making a successful qualifying transaction made directly to the eligible Aldar Academy, Points will be credited directly to the Member’s account within ten (10) working days. To qualify for earning Darna points, the email address used for both the school records and Darna registration must match. Additionally, only tuition and registration fees are eligible for earning Darna points.
    • Asteco Leasing – post making a successful qualifying transaction made directly to Provis for Aldar owned units, Points will be credited directly to the Member’s account within ten (10) working days. To qualify for earning Darna points, the email address used for both the Asteco records and Darna registration must match.
    • Aldar Properties – Starting from July 1st, 2023, new purchases will not be qualified for Darna points. All past qualified purchases, having subsequent payments, will remain eligible for Darna points. Post making a successful qualifying transaction made directly to Aldar Properties, Points will be credited directly to the Member’s account within ten (10) working days. To qualify for earning Darna points, the email address used for both the Aldar Properties records and Darna registration must match.
    • Inspire Home (Home Maintenance Services) – post making a successful qualifying transaction made directly to Khidmah Home Maintenance, Points will be credited directly to the Member’s account within ten (10) working days. To qualify for earning Darna points, the email address used for both the Inspire Home records and Darna registration must match.
    • Hospitality F&B and SPA – post making a successful qualifying transaction directly at a participating Hospitality outlet, Points will be credited immediately upon successful payment with a Linked Card.
    • Retail Malls and Community Centres – post making a successful qualifying transaction at a participating Aldar Retail Mall or Community Centre Participating Outlet, Points will be credited to the Member’s account within fifteen (15) working days of successful payment with a Linked Card. For more information on earning Points at Retail Malls and Community Centres, please see section G below.
    • Golf Courses F&B – post making a successful qualifying transaction directly at a participating Golf Course outlet, Points will be accrued after successful payment with a Linked Card.
    • Parks and Beaches F&B – post making a successful qualifying transaction directly at a participating restaurant, Points will be credited immediately upon successful payment with a Linked Card.
    • Attractions – post making a successful qualifying transaction directly at a participating Attractions outlet, Points will be credited within ten (10) working days of successful payment with a Linked Card.
      Attractions in the programme: Qasr Al Watan, Louvre Abu Dhabi, Qasr Al Hosn, Clymb, Husaak Adventure.
    • Theme Parks – post making a successful qualifying transaction above 50 AED, directly at a participating Theme Park, Points will be credited within ten (10) days upon successful payment with a Linked Card.
      Theme Parks in the programme: Ferrari World, Warner Bros World, Yas Waterworld.
  2. Starting 1st December, 2025 Points earned will be valid for 18 months from date of earning. All unused Points will automatically expire after 18 months and therefore can no longer be used for redemption.
  3. Points earned before 1st December, 2025 will be valid for 24 months.
  4. Under no circumstances can Points be re-credited after redemption.
  5. Returns, refunds and cancellations of Aldar Group services or products must happen as per Aldar Group terms of purchase. In the event of a cancellation, return or refund from Khidmah Home maintenance services, Aldar Properties, Provis or Aldar Academies, Aldar reserves the right to revoke Points awarded based on the original transaction value. If your Points have already been redeemed before the refund/cancellation has been completed, Aldar will deduct the value of Points (in AED) from the balance of the refund due.
  6. Points cannot be pooled with the Points balance of any other member.
  7. Points earning rate is calculated by Aldar and is subject to change at any time without prior notification.
  8. Points can only be earned on qualifying transactions at Participating Outlets and through Programme Partners as mentioned in the Darna App. Aldar reserves the right to add or remove any of the Participating Outlets anytime without prior notice. Aldar will make reasonable efforts to advise you of any changes in advance.
  9. To claim missing Points, follow the process as described below:
    • Email the Darna Customer Service team at customerservice@darnarewards.com.
    • On request, provide details of missing Points including proof of purchase, a credit/debit card receipt, and proof of identity. This may include invoice number, invoice date, and Programme Partner in order to verify the claim. Only claims made within 30 days of purchase will be considered. Any claims for transactions where Points or credit notes have been used are not eligible.
    • The claim shall be processed only if the details provided match those with Aldar’s records.
    • Aldar reserves the right to refuse any claim.
    • A Member cannot claim Points for a transaction made by another person or on behalf of another person.
  10. Aldar reserves the right to adjust the number of Points accrued if the Points were accrued as a result of error or misrepresentation, negligence, card or terminal malfunction or for any other reason resulting in the Darna Points being invalidly accrued.

F. Redeeming Points

  1. Points can be redeemed by visiting any Participating Outlets or via the Darna App across multiple redemption channels.
  2. There is a minimum of 50 AED worth of Points required to make a redemption for an Aldar Gift Card.
  3. To redeem at an Aldar asset (where applicable) the Member must present their Darna App and/or provide their registered email address.
  4. Points will be automatically deducted from the Member's account at time of redemption. Points can be redeemed in full or as part points/part cash. If the value of the purchase exceeds the sum total of the Points available in your membership account, the balance amount must be paid by the Member using a valid payment method.
  5. Points once redeemed cannot be re-used or re-credited.
  6. Points cannot be bought, sold or in any way traded. Points cannot be exchanged for cash.
  7. To redeem Points in the Darna App, Members can select one of the options available to them, including ‘Cash Back’ which allows the Member to cash their Points out onto a Linked Card of choice whenever the Member would like ‘Cash back’. The appropriate number of Points will then be deducted, and the equivalent cash amount will be credited back onto the Member’s chosen Linked Card (Visa & Mastercard). The ‘Cash Back’ option has a maximum amount of AED 2,000 daily.
  8. Other ways to redeem Points on the Darna App include redemption for an Aldar Gift Card (annual cumulative limit of AED 36,000 only per customer applies), and charitable donations. Aldar reserves the right to update the redemption options for customers as required and more information about these options can be found within the Darna App. To redeem Points please follow the below steps:
    • Open the Darna App
    • Select the category you want to redeem at
    • Add the value in AED you wish to redeem
    • Follow the steps to complete the redemption
    • Steps may vary based on the option chosen for redemption

G. Retail Malls, Community Centres and Hospitality – Card Linking and Eligible Cards

General

  1. The Darna Programme will allow Members to earn Points for transactions made at participating Aldar Retail Malls and Community Centres using an eligible (“Linked Card”), which is a valid UAE issued Visa or Mastercard credit or debit card. The Darna Programme will also allow members to redeem Points via Aldar Gift Card.
  2. A Member that links an eligible card to the Darna Programme (“Eligible Card”) will be able to earn and redeem Points at participating Aldar Retail Malls, Community Centres, and selected Hospitality assets. Members can also redeem Points against card transactions made with a Linked Card at participating Retail Malls, Community Centres and Hospitality Participating Outlets (“Eligible Transaction”).
  3. To earn Points for purchases made at participating Aldar Retail Malls, Community Centres and Hospitality assets, you must be a Member of Darna and have registered an Eligible Card in the Darna mobile app under the ‘Wallet’ section. Members can use their registered Linked Card to pay for transactions at participating locations. There may be a minimum purchase value applied that can change at any time at the discretion of Aldar. For the avoidance of doubt, an Eligible Card will include any valid Visa or MasterCard payment card that belongs to the Member, including but not limited to Visa or MasterCard credit cards, Visa or MasterCard debit cards and Visa or MasterCard pre-paid cards.
  4. For participation in the Darna Programme an Eligible Card must be issued within the United Arab Emirates.
  5. Aldar reserves the right to reverse invalid transactions for any reason at their own discretion.
  6. Ineligible Cards include: Visa/MasterCard-branded gift cards or a Visa or MasterCard that has expired, is inactive, cancelled, stolen or is otherwise invalid at the time of making an eligible transaction pursuant to these Terms (“Ineligible Transaction”).
  7. Eligible Transactions include Eligible Card transactions made at point-of-sale terminal using swipe, PIN or Tap to Pay. This includes transactions made using Apple Pay, Google Pay etc.
  8. Up to five (5) Eligible Cards can be added on the Darna App under the ‘Link Card’ section.
  9. By linking an Eligible Card, you warrant and confirm that you are the authorised card holder to use that Eligible Card and you are the same person who holds the Darna membership account. In the event that Aldar discovers you are not the authorised card holder of the Eligible Card, your account will be suspended for investigation.
  10. It is the Member’s responsibility to ensure that the Eligible Card details are correct and entered correctly in the ‘Wallet’ section on the Darna mobile app.
  11. Should an Eligible Card linked to the Darna App become expired or invalid due to theft, cancellation or suspension, it is the Member’s sole obligation to delete this card and update accordingly in the Darna App. For the avoidance of doubt, any transaction made on an expired or invalid card cannot and will not retrospectively earn Points.
  12. Aldar accepts no responsibility for fraudulent transactions made with your Linked Card. By linking an Eligible Card, you are providing your express consent for Aldar to authorize the credit card issuer and/or the payment card processor, as Aldar’s service provider, to monitor your Linked Card transactions for Eligible Transactions.
  13. For Members who have linked an existing Eligible Visa Card to another loyalty Programme operating in the same participating Aldar Retail Malls, they will have the option to earn both loyalty currencies for the same transactions. Aldar has the right to amend this rule at their own discretion. Terms and conditions for currency accrual with any other loyalty Programme prevail and should be reviewed accordingly by Members. If Members do not have their Eligible Linked Visa Card in both programs at the time of transaction, then the double earn will not be eligible.

Removal of Linked Cards

  1. It is the Member’s responsibility to remove any Linked Cards that they no longer wish to earn Points through.
  2. Expired or invalid Linked Cards will need to be removed by the Member from the Darna App by clicking on the “Delete card” icon in the “Link Card” section in the Darna mobile app.
  3. If the Member receives a new card from their financial institution, it is the obligation of the Member to check the card details are the same as their previously Linked Card and if not, they will have to update the details in the Darna mobile app by clicking on the “Delete card” icon in the “Link Card” section of the Darna App.

Earning and Redeeming Points Through Your Linked Card

  1. You can view the Points balance and its equivalent AED amount in the wallet section of the Darna App. Points you have already earned can be seen in the wallet section within the Darna App. Points (excluding Points which have been refunded or reversed) will be awarded to your account within fifteen (15) days after you have completed an Eligible Transaction.
  2. Members earn Etihad Miles only for transactions in Yas Mall, Al Jimi Mall, World Trade Centre Mall, Al Hamra Mall and Aldar Community Centres. If a Member is part of Darna and has also linked their card with Etihad’s Miles on the Go Programme to earn Etihad Miles, they will do so but only with transactions, with a minimum amount of AED 50, in these Aldar assets and this is applicable on Visa cards transactions only. Beyond that, Members will earn Darna points only.
  3. Members can only earn Etihad Miles whilst using their linked Visa card and not through their MasterCard.
  4. Transactions under 50 AED will not earn Etihad Guest Miles based on the Etihad Miles on the Go Programme terms and conditions.

Refunds and Reversals

Where an Eligible Transaction is refunded or reversed within fifteen (15) days of the Eligible Transaction being made, no Points will be awarded for that transaction. Any partial refunds or reversals made within fifteen (15) days of the Eligible Transaction, you will only receive Points for the part of the transaction not reversed or refunded.

Your Points will be pending throughout the fifteen (15)-day refund period. Pending Points are Points you have earned that have not yet been allocated to your account. Pending Points will be made available in your Darna membership account after a period of up to fifteen (15) days from the date of purchase. Once these Points have been awarded you will be able to redeem them.

Checking Your Darna Transactions

  1. You can review your Darna transactions on the Darna App. Points available to redeem will appear under ‘Wallet’ on the Darna App.
  2. In case Darna Points are not credited to your Darna membership account within a period of thirty (30) days, you can raise a request to customerservice@darnarewards.com.
  3. When submitting the claim for missing Points, you will need to provide your registered email address along with proof of purchase. Proof of purchase will include the date of the Eligible Transaction, a valid credit/debit card receipt and details of the Participating Outlet where your Linked Card was used.
  4. For a claim to be eligible, the registration of the Linked Card used for the Eligible Transaction must pre-date the date of purchase. All validated missing Points requested will be processed within six (6) months.

H. Darna Rewards / Offers

General

  1. To avail Darna Rewards/Offers, the Member will be required to make the redemption through the Darna App by following the process as set out below. To avail more than one Offer, repeat the same process:
    • Tap on the Offer to be redeemed
    • Ask the authorised agent to enter their PIN
    • A success screen showing your redemption has been successful will be shown on the Darna App and the appropriate item or service will be removed from the bill
  2. In the case of a dispute, the bill must be settled as per local law.
  3. Offers redeemed are not inclusive of any applicable service charges/taxes including but not limited to VAT, GST etc (as applicable) and will be separately charged by merchants in compliance with local tax regulations/laws.
  4. Pool day charges are complimentary but must be arranged with the participating hotel 48 hours prior to visitation.
  5. Each Offer will have its own terms and conditions and can be found in the Darna App, detailed with each Offer.

Exclusion Days

  1. Offers can be used 7 days a week, excluding the following days in the following markets and any other public holidays as announced by the applicable government (subject to merchant discretion): UAE
    • 24 December
    • 25 December
    • 31 December
    • 1 January
    • Eid Al Fitr
    • Eid Al Adha
    • 14 February
    • Martyrs Day / Commemoration Day
    • National Day
  2. Note that a limited number of outlets may be closed over the summer, Ramadan and other selected religious holidays. Aldar cannot be held responsible if an outlet is temporarily or permanently closed during the Offer validity period.

I. Promotions

K. Intellectual Property

The content of the App is protected by copyright, trademark and other intellectual property rights as applicable.

Content (including, but not limited to, information, communications, software, images and sounds contained on or available through the App) is provided by us. The Intellectual Property Rights to or over the contents contained in the Darna App or website belongs to us, its content providers and/or third parties. All rights are reserved. The contents of the Darna App or website cannot be copied, reproduced, modified, transferred, distributed, republished, downloaded, posted or transmitted in any form or by any means including but not limited to electronic, mechanical, photocopying, printing or recording without our prior written permission. The end-user agrees the material and content referred to above is for own personal use only and may not be used for commercial purposes.

“Intellectual Property Rights” means all intellectual property rights of whatever nature throughout the world including all rights conferred under statute, common law or equity, including (without limitation) rights in relation to copyright, patents, trademarks, formulae, databases, business processes and methods, design rights, trade secrets, trading names, service marks, and all rights to receive profit or royalties from such rights or licences of such rights.

Limitation of Liability

You acknowledge and accept that to the maximum extent permitted by applicable law, Aldar shall not be liable for any claim, damage, loss or hazard resulting from:

  • the use or inability to use the Darna App or website services;
  • the unauthorised access or alterations to your personal information, or your transmissions to or from the Darna App or website, by a third party, except to the extent resulting from our negligence or wilful default;
  • any interruption or cessation of transmission to or from the Darna App or website;
  • any bugs, viruses, Trojan horses, or the like which may be transmitted to or through our Darna App or website;
  • the loss or misuse of your information (or any part of it) or login details, except to the extent resulting from our negligence or wilful default; and/or
  • any other matter relating to this Darna App or website, except to the extent resulting from our negligence or wilful default.

Warranties

To the fullest extent permitted by law and except as specified in these Terms, we do not give any implied or express warranties in relation to the use or availability of the Darna App or website services. In particular, we do not warrant that:

  • the speed and the reliability of the Darna App or website services will be adequate for any particular activity you may wish to perform using the Darna App or website services;
  • our Darna App or website will be compatible with any devices or software which you may attempt to use to login to our App;
  • our Darna App and website services will provide continuous, fault-free network connectivity or uninterrupted data traffic flow;
  • your connection to the Darna App or website services will be safe and secure; or
  • any of the information published on or transmitted via the Darna App or website services is accurate.

Waiver

Failure by us to exercise or enforce any term of these Terms and Conditions or any other right or remedy will not constitute a waiver of that or any other term, right or remedy.

Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of UAE as applicable in Abu Dhabi and the parties agree to submit to the exclusive jurisdiction of the courts of Abu Dhabi.

Variation of Terms

The revised Terms will take effect when they are posted. If the Terms as so revised are unacceptable to you, you must stop using our App Services. If you continue to use our App Services, you will be deemed to have accepted the revised Terms. Where the changes materially affect your data rights or how we process personal data, we will provide prior notice (e.g., via email or App notification) and, where required by law, obtain your consent.
